Lowenstein Sandler serves as bankruptcy counsel to the certified class of consumer privacy plaintiffs in the Facebook consumer privacy user profile class action pending in the United States District Court for the Northern District of California, in which a federal judge has granted preliminary approval of a $725 million settlement for all Facebook users in the U.S. between May 2007 and December 2022.

In particular, Lowenstein Sandler represents the consumer privacy plaintiffs in the Cambridge Analytica Chapter 7 bankruptcy case; Cambridge Analytica is the political consultancy at the center of the class action litigation.

As reported in Law360, the dispute arises from the 2018 “revelation that an app developer had taken personal data from … unsuspecting Facebook users and sold it to Cambridge Analytica, a U.K.-based political consulting firm hired by former President Donald Trump's 2016 campaign. Cambridge Analytica filed for bankruptcy shortly afterward.” The article calls the deal a "historic privacy settlement of claims against Facebook."

A final approval hearing is scheduled for early September.

Lowenstein's Bankruptcy & Restructuring Department team members include Michael S. Etkin, Nicole Fulfree, and Michael Papandrea.
