This Privacy Policy describes how Lowenstein Sandler LLP and its affiliate, Lowenstein Sandler Inc. (collectively, “Lowenstein,” “we,” “us,” or “our”) collect, use, share, retain, and otherwise process your personal information. It applies to information collected when you visit our websites located at www.lowenstein.com and www.venturecrush.com, or any other digital or online properties or services that link to this Privacy Policy, including any mobile application or version of the sites (collectively, the “Sites”), or when you interact with us in any other way. Please note that we may provide you with different or additional privacy notices when we collect personal information in certain contexts or for specific purposes, such as when we collect information from our partners, employees, job candidates, contractors or service providers.
By browsing, accessing or using our Sites, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

Individuals Located in the European Economic Area (“EEA”) and the United Kingdom (“UK”). Natural persons who are located in the EEA (i.e., the European Union, Iceland, Liechtenstein, and Norway) and the UK should review the GDPR Privacy Notice for Individuals located in the European Economic Area and the United Kingdom for their specific rights, remedies, and related information. The GDPR Notice supplements this Privacy Policy.
I. The Information We Collect, and How We Collect It
We collect the following categories of information, which may include personal information (collectively, the “Information”).
1. Information You Provide to Us
We collect information from and about you directly when you provide it to us. This information may be collected when you contact us, fill out a form, access or participate on our Sites, respond to surveys, or otherwise interact with us, such as through social media or networking sites. This information may include:
Contact Information. We collect your contact information on our Sites when you voluntarily provide it to us. For example, you may disclose contact information to us via the “Contact Us” link on our Sites, submit information by mail, telephone, or electronically, when signing up for newsletters, alerts, whitepapers, legal insights and other marketing communications, or when you register to attend an event or program. Contact Information may include first name, last name, e-mail address, postal address, employer, telephone number and other information that identifies you or can be used to identify or contact you.
In addition to Contact Information, we may collect other kinds of information, such as:
- Comments, questions, and requests you may make;
- Information about your preferences, such as your preferred methods of communication and the types of information in which you are interested;
- Event and service-related information (such as information required for registration, access to premises or online resources, dietary restrictions, and areas of interest);
- Audio and visual information, such as photographs, video and voice recordings (e.g., from events you attended with us), or security camera recordings if you visit our offices;
- Details of downloads from our Sites;
- Records and copies of your correspondence (including email addresses and phone numbers), if you contact us; and
- Any other information you voluntarily provide.
2. Information Obtained From Third Parties
We may receive certain information about you from other sources, including publicly available sources (such as public records and social media platforms), as well as our clients, service providers, partner organizations and marketing partners.
When we collect personal information from users and visitors of other sites on which you have interacted with us, we will do so in accordance with the terms of use and privacy policies of those sites and applicable law. We may also receive personal information when you comment on our social media advertisements, post comments about us, or tag us in a public-facing social media post. Personal information may also be collected by the third-party social media sites that host our social media pages. These sites may provide aggregate information and analysis to us about visitors' use of our social media pages. This allows us to better understand and analyze our user growth, general demographic information about the users of these pages, and interaction with the content that we post. Overall, this information may be used to help us understand the types of visitors and users of our social media pages and use of the content. This Privacy Policy does not cover personal information collected by such third-party social media sites. 3. Information Collected Automatically
We and our service providers may automatically obtain certain information about you, your electronic device, and your interactions with us, including the following:
Lowenstein automatically collects personal information when you access or use the Sites. The types of personal information Lowenstein collects may include:
- Log Information: We collect log information about your use of the Sites, including your browser type and language, app version, access times, pages viewed, Internet Protocol (“IP”) address, links clicked, approximate geographic location, and the webpage you visited before navigating to the Sites.
- Device Information: We collect information about the mobile device you use to access the Sites, which may include the hardware model, operating system and version, unique device identifiers, and mobile network information.
- Location Information: In accordance with your device permissions, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time
- Information Collected by Cookies and Other Tracking Technologies: We and our service providers use various technologies to collect information about your use of the Sites and other websites and applications, including cookies and web beacons (or pixel tags). Cookies are small data files stored on your hard drive or in device memory that help us to, among other things, improve the Website and your experience, see which areas and features of the Sites are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that may be used on the Sites or in our emails and help deliver cookies, count visits, understand usage and campaign effectiveness, and determine if an email has been opened and acted upon.
Analytics Providers. We may engage third party analytics services (such as Google Analytics) to collect and analyze various data regarding your usage and activity on the Sites. Analytics services may use tracking technologies (e.g., pixel tags and cookies) to collect information on our behalf including your IP address, ISP, browser type, operating system and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Sites you visit, number of links you click while on the Sites, search terms, and other data. We may also collect information regarding your mobile device, including the type, operating system and version (e.g., iOS, Android or Windows), processor information, network type, and similar data. Please be advised that if you opt out of any analytics service, you may not be able to use the full functionality of the Sites.
Remarketing services. We use one or more third-party remarketing services to advertise on third-party websites to previous visitors to our Sites. These third-party remarketing service providers use cookies to serve ads based on a past visit to the Sites. Any data collected by such third party remarketing service providers will be used in accordance with this Privacy Policy and the privacy policy of such third party remarketing services provider. 4. Summary: Categories of Personal Information Collected
Lowenstein collects, and has in the preceding 12 months collected, the following categories of personal information:
- Identifiers: Name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers;
- Customer records information: Name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit or debit card number, other financial information, medical information, health insurance information;
- Characteristics of protected classifications under California or federal law: Race, religion, sexual orientation, gender identity, gender expression, age;
- Commercial information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;
- Biometric information: Hair color, eye color, fingerprints, height, retina scans, facial recognition, voice, and other biometric data;
- Internet or other electronic network activity information: Browsing history, search history, and information regarding a consumer’s interaction with an Internet website, application, or advertisement;
- Geolocation data;
- Audio, electronic, visual, thermal, olfactory, or similar information;
- Professional or employment-related information;
- Education information: Information that is not “publicly available personally identifiable information” as defined in the California Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99); and
- Inferences (such as preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, aptitudes).
II. How We Use and Share Your Information
1. The Purposes for Which we use Your Information, and to Whom we Disclose it
The Information is used by Lowenstein for the purpose for which it was collected and in a manner that is consistent with this Privacy Policy. These functions include operation, maintenance and improvements to the Sites, providing our services, solicitation of your feedback, responding to your requests and questions, hosting events (including webinars and hosted events), and informing you about our firm, services, events, and other areas of interest.
Site Visitors voluntarily provide personal data for the purpose of receiving additional information or registering for a service or event. The personal data provided by Site Visitors through our “Contact Us” link is used only to provide them with communications in specialty areas they select. When Site Visitors register via our Sites for an event (including webinars and hosted events), we use the personal data they have provided solely for purposes of contacting them about the event, and to let them know about future events if they have indicated that they would like to receive that information. We also use the information provided by our Site Visitors to respond to and process their requests.
Aggregated Data. We may analyze your personal information in aggregate form which does not identify you personally (“Aggregated Data”). The Aggregated Data may be used to operate, maintain, manage, and improve the Sites, shared with our affiliates, agents, and business partners, and otherwise used and disclosed for lawful business purposes.
Service Providers/Vendors. Like many businesses, we hire other companies to perform certain business-related services. We may disclose personal information to certain types of third party companies but only to the extent needed to enable them to provide such services. The types of companies that may receive personal information and their functions are: web hosting companies, disaster recovery services, client survey and marketing services, and data storage. All such third parties perform services on our behalf pursuant to contracts which require that they provide the same level of privacy protection as is required by this privacy policy.
Reorganization. If in the future Lowenstein undergoes a corporate, partnership, or business reorganization, we may transfer the Information, including personal information, to the surviving entity.
Protection of Rights and Compliance. We may use your Information to protect the rights, privacy or safety you, us or others; to ensure our compliance with legal and contractual requirements; and to prevent and investigate illegal, unethical, or unauthorized activities (including cyberattacks and identity theft).
Disclosure to Public Authorities. If we reasonably believe that we are required to do so by law, we will disclose personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. We may also disclose personal information to other third parties when we reasonably believe we are compelled to do so by government authorities or required by law or regulation including, but not limited to, in response to court orders and subpoenas.
If Lowenstein intends on using or disclosing your personal information in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the personal information is collected.

III. How We Protect Your Information
We take commercially reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the personal information that you supply will not be intercepted while being transmitted to and from us over the Internet.
IV. Data Retention
Lowenstein determines the retention period for all Information based on the following criteria: (i) the purposes for which we collect and/or receive the Information (we need to retain the data as long as necessary for such purposes); and/or (ii) tax, legal and regulatory requirements (laws or regulation may set, or recommend, a minimum or maximum period for retention of your Information). In addition to this, we may consider other factors, such as the nature and sensitivity of the data, and whether we can achieve the purpose for which we collected the data through other means.
V. Your Privacy Choices
Marketing Communications. You may opt-out of marketing-related emails by clicking on the “unsubscribe” link located on the bottom of any marketing email or emailing us at privacycontact@lowenstein.com. We will use commercially reasonable efforts to process such requests in a timely manner. Please note that even if you opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
Do Not Track. As discussed above, third parties such as advertising networks and analytics providers may collect information about your online activities over time and across different websites when you access or use the Sites. Currently, various browsers offer a “Do Not Track” option, but there is no standard for commercial websites. At this time, we do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals. Cookies. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Sites.
VI. Children
We do not knowingly collect personal information from children under the age of 18 through the Sites. If you are under 18, please do not give us any personal information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information through the Sites without their permission. If you have reason to believe that a child under the age of 18 has provided personal information to us, please contact us, at privacycontact@lowenstein.com and we will endeavor to delete that information from our databases.
VII. External Websites
The Sites may contain links to third-party websites. These third-party sites may collect information about you if you click on a link. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.
VIII. International Data Transfers and Important Notice to Non-U.S. Residents
The Sites are hosted in and provided from the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States where the privacy laws may not be as protective as those in your country of origin. If you are located outside the United States and choose to use the Sites, you consent to any transfer and processing of your personal information in accordance with this Privacy Policy, and you do so at your own risk.
Lowenstein complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Lowenstein has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Lowenstein has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Lowenstein is subject to the investigatory and enforcement powers of the Federal Trade Commission.
In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Lowenstein commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF, the UK extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. EU, UK, and Swiss individuals with inquiries or complaints should first contact Lowenstein at privacycontact@lowenstein.com.
Lowenstein has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. X. Notice to California Residents
If you are an individual located in the State of California, please review this section for further information regarding the processing of your personal information and your rights under applicable state law.
1. Sale or Sharing of Personal Information
We do not sell or share, for purposes of cross-context behavioral advertising, your personal information and have not done so in the past twelve months.
2. Minors Under the Age of 16
We do not have actual knowledge that we sell or share the personal information of minors under the age of 16.
3. Your Rights as a California Resident
As a California resident, you may have certain rights in relation to your personal information.
a) Right to Know
You may have the right to know how we have collected, used, and disclosed your personal information. Specifically, you may have the right to know:
- The categories of personal information we have collected about you;
- The categories of sources from which we have collected your personal information;
- The business or commercial purpose for which we collect, sell or share your personal information;
- The categories of third parties to whom we have disclosed your personal information;
- The categories of personal information that we have sold or shared about you and the categories of third parties to whom it was sold or shared; and
- The categories of personal information we have disclosed about you for a business purpose and the categories of persons to whom we have disclosed it.
In addition, you may have the right to know the specific pieces of personal information we have collected about you.
b) Right to Make a Deletion Request
You may have the right to request that we delete the personal information about you that we have collected or received. Subject to certain exceptions, we must delete your personal information and direct our service providers and contractors to do so.
c) Right to Correct Inaccurate Personal Information
You may have the right to request that we correct inaccurate personal information about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.
d) Right to Opt-Out of Sales of Personal Information
If we sold your personal information (as defined by CCPA), you would have the right to opt-out of the sale of your personal information.
e) Right to Opt-Out of Sharing of Personal Information
If we shared your personal information (as defined by CCPA), you would have the right to opt-out of us sharing your personal information for cross-context behavioral advertising purposes.
f) Right to Limit Use and Disclosure of Sensitive Personal Information
If we collected sensitive personal information about you (as defined by CCPA), you would, subject to certain exceptions, have the right to limit our use and disclosure of your sensitive personal information. Please note, however, that we do not do so.
g) Right to Non-Discrimination
You have the right not to be discriminated against by us for choosing to exercise your rights under the CCPA.
4. How to Exercise Your California Privacy Rights
If you wish to exercise your right to know, delete, or correct inaccuracies in your personal information, please submit a request to us by contacting us as outlined below.
a) Information for Authorized Agents
You can authorize a person (“Authorized Agent”) registered with the California Secretary of State to exercise your California privacy rights on your behalf. An Authorized Agent can also include a person who has power of attorney or is acting as a conservator. To submit a request to Lowenstein on behalf of another person as an Authorized Agent, please submit a request to us by contacting us as outlined 14 below.
b) Verifying Your Requests
We only respond to your requests to know, access the specific pieces of personal information we have about you, delete and correct inaccurate personal information when we can verify that you are a California resident exercising your rights regarding your personal information. We may need to ask you for personal information to verify your request so we can match it to the personal information we already have about you. We may also need to obtain additional information about you that we do not already have. If you provide us with new personal information that we do not already have about you, we will use it solely for the purpose of verifying your request. We will let you know via email if we need more information from you to verify your request. Please reply to our requests promptly. We will communicate with you about your requests via email. We will use the email address you provided when submitting your request. If we cannot verify your identity, we will let you know.
c) Responding To Your Requests
We aim to promptly verify and respond to your requests within 45 days of receipt but may require a total of up to 90 days to respond to your requests. If we require additional time beyond the initial 45 days after we receive your request, we will let you know within the first 45 days. We do not ordinarily charge a fee for our response to your requests. However, we may do so to the extent your request(s) are excessive, repetitive, or manifestly unfounded. If we determine that charging a fee is warranted, we will let you know and will provide you with an estimate of the associated costs of responding to your request(s). If we determine that we cannot or will not take the action that you requested, we will let you know. We will inform you of our reasons for not taking action and any rights you may have to appeal the decision. Unless you tell us that you would like to receive a response via postal mail, we will respond to you via email regarding your requests to know and to access the specific pieces of personal information we have about you. We will contact you at the email address you provided when submitting your request(s). If you would like to receive responses to a request to know or access personal information via postal mail rather than email, please let us know when submitting your request(s).
5. Other California Privacy Rights
Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use. Such requests may be made once per calendar year for information about any relevant third-party sharing in the prior calendar year. To submit a “Shine the Light” request, call or email us as outlined in section 14 below, and include in your request a current California address and your attestation that you are a California resident. Please note, however, that we do not, nor have we in the past, shared any personal information with third parties for such purposes.
XI. Notice to Nevada Residents
If you are a resident of Nevada, you have the right to opt-out of the sale of personal information to third parties. You can exercise this right by contacting us at privacycontact@lowenstein.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.
XII. Changes to This Privacy Policy
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Sites. By accessing the Sites after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
