The Lowenstein lawyers’ highly read article analyzes The Corporate Transparency Act (CTA), which became effective on January 1, 2024, and its requirement that U.S. and foreign companies authorized to do business in the U.S. report specific personal information (PII) regarding their beneficial owners to the U.S. Department of the Treasury Financial Crimes Enforcement Network (FinCEN). The authors encourage companies to establish internal and external processes to identify BOI and FinCEN Identifiers as sensitive personal information, to evaluate their PII and determine applicable data protection laws, and to integrate the PII into legally compliant data protection programs.
